In accordance with Spanish Law 2/2023 of 20 February, governing the protection of persons who report regulatory breaches and the fight against corruption, all companies with more than 50 employees are required to have an internal reporting channel that enables reports to be submitted concerning acts that may constitute a serious criminal or administrative offence or a breach of European Union law.
The legislation also establishes the obligation to make information available to interested parties regarding the use of any internal reporting channel, as well as the essential principles governing the procedure.
To ensure compliance with the above requirements, we make the following documents available:
WHISTLEBLOWING CHANNEL. This whistleblowing channel guarantees compliance with the provisions of the aforementioned legislation, in accordance with Articles 7 and 9 thereof.
ANONYMOUS REPORTS AND PERSONAL DATA. Reports may be submitted anonymously, and the reporting person is not required to provide identification. Replies will be provided through the same channel used to submit the report. For this purpose, the reporting person must retain the tracking code assigned in the acknowledgement of receipt.
Anonymity will only be lifted with the reporting person’s express consent or where disclosure constitutes a necessary and proportionate obligation imposed by European Union or national law in the context of an investigation conducted by national authorities or judicial proceedings, particularly to safeguard the rights of defence of the person concerned.
Compliance with applicable data protection legislation, including Spanish data protection legislation and the GDPR, will be guaranteed throughout the entire process.
USE OF THE WHISTLEBLOWING CHANNEL. When submitting a report, you will be redirected to an online tool located outside the Capital Genetic EBT, S.L. domain. The message will be transmitted through a tool operated by an external service provider in order to guarantee complete objectivity and transparency in the report management process.
In all cases, the external service provider will comply with the instructions established by Capital Genetic EBT, S.L. and will act in accordance with applicable data protection legislation, ensuring compliance with the obligations set out in Article 28 of the GDPR.
This tool may therefore be used by any employee of Capital Genetic EBT, S.L., as well as by any third party who may become aware of unethical, fraudulent or unlawful conduct committed within our organisation.
This whistleblowing channel is not intended for matters relating to employment conditions or disciplinary issues. In such cases, the policies and procedures established within the organisation must be followed.
The data controller is Capital Genetic EBT, S.L., which will process the information collected through the channel in compliance with the legal obligation established by Spanish Law 2/2023 of 20 February, governing the protection of persons who report regulatory breaches and the fight against corruption.
The information will be processed for the purpose of managing reports received through the channel, while guaranteeing the confidentiality of the reporting person’s data. Such data will be kept anonymous and will not be disclosed to third parties unless identifying the reporting person constitutes a necessary and proportionate obligation imposed by European Union or national law in the context of an investigation conducted by national authorities or judicial proceedings. In such cases, the information must be disclosed to the competent authorities.
Your data will be retained for a maximum period of three months from the date on which it is entered into the channel. However, it may remain blocked where necessary to provide evidence of the operation of the crime prevention model or where it may be required by the competent authority to initiate the corresponding investigation into the reported facts.

The personal data you provide through the form, together with any personal data contained in the supporting documentation submitted with your report, will be processed for the purpose of managing reports received through the channel, conducting investigations into the alleged facts reported and, where appropriate, adopting protection and/or anti-retaliation measures. All such processing will be carried out in accordance with the Internal Reporting System Policy and the Whistleblowing Channel Management Protocol.
We hereby inform you that your identity, where provided or otherwise identifiable, will be kept confidential and will not be disclosed to the persons concerned by the alleged facts described in the report.
